This English version is provided for your convenience. Only the German version is legally binding.
§ 1 Scope
(1) These General Terms and Conditions apply to all orders placed by consumers and businesses via the online shop at oavo.shop.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities (§ 13 German Civil Code, BGB).
(3) Deviating terms of the customer are not recognised unless we expressly agree to their validity.
§ 2 Contracting party
The purchase contract is concluded with Oavo. You can find the full contact details in our Imprint.
§ 3 Conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) By clicking the button “Place order with obligation to pay” (“Zahlungspflichtig bestellen”), you place a binding order for the goods in your shopping cart. Before submitting your order, you can check your entries at any time and correct them using the browser functions or the editing options in the cart and checkout.
(3) Immediately after receiving your order, you will receive an automatic email confirming receipt of your order (order confirmation). The purchase contract is concluded with this order confirmation, but no later than upon dispatch of the goods.
(4) If you pay via PayPal, Klarna, Apple Pay or Google Pay, the contract is concluded, in deviation from para. 3, at the moment you complete the payment process with the respective payment provider.
§ 4 Contract language and storage of the contract text
(1) The contract language is German.
(2) We store the contract text. We will send you the order details and these terms by email. You can view the current terms at any time on this page. If you have created a customer account, you can view your orders there.
§ 5 Prices and shipping costs
(1) All prices are final prices in euros. As a small business owner within the meaning of § 19 of the German VAT Act (UStG), we do not charge VAT and therefore do not show it.
(2) Any shipping costs are shown on the respective product page and in the cart or at checkout before you place your order.
§ 6 Delivery, delivery area and delivery time
(1) We deliver exclusively to delivery addresses within Germany.
(2) Delivery takes 3–5 business days unless stated otherwise for the respective product. For prepayment (PayPal, credit card, Apple Pay, Google Pay), the period begins on the day after the payment order; for all other payment methods, on the day after conclusion of the contract. If the period ends on a Saturday, Sunday or public holiday, it ends on the next business day.
(3) If an ordered item is not available, we will inform you immediately. Any payments already made will be refunded without delay.
§ 7 Payment
(1) The payment methods shown during checkout are available, in particular PayPal, Klarna, credit card, Apple Pay, Google Pay and SEPA direct debit (via PayPal).
(2) Payment is processed by the respective payment provider, whose terms of use and privacy policy also apply. For payments via Klarna (e.g. invoice or instalments), Klarna’s terms apply.
(3) The purchase price is due immediately upon conclusion of the contract, unless otherwise agreed for the chosen payment method.
§ 8 Retention of title
The goods remain our property until full payment has been made.
§ 9 Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days. Details, the consequences of withdrawal and the model withdrawal form can be found in our withdrawal and returns policy. The customer bears the direct costs of returning the goods.
§ 10 Warranty
(1) The statutory warranty rights apply.
(2) Please report obvious transport damage to the delivery company as soon as possible and inform us. If you do not do so, this has no effect on your statutory rights.
§ 11 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.
(2) In the event of a slightly negligent breach of an essential contractual obligation (cardinal obligation), liability is limited to the foreseeable damage typical for the contract. Cardinal obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely.
(3) Otherwise, liability for slight negligence is excluded.
(4) Please observe the safety and usage instructions for the training equipment. If you have any health restrictions, we recommend seeking medical advice before training.
§ 12 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have any questions or problems, you can reach us by email at any time – we will find a solution together.
§ 13 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state of their habitual residence.
(2) Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
